AG: Camera-based Citations Are Legal

NASHVILLE, Tenn. (AP) -- Tennessee Attorney General Robert Cooper reaffirmed Monday that citations based on traffic cameras are constitutional.
The AG opinion noted that if the cameras are operated by private vendors under contracts with cities, the citations are legal if law-enforcement personnel from the city review the photographic evidence first.
The Memphis Commercial Appeal reports the opinion cited a Tennessee Court of Appeals ruling in July upholding the constitutionality of the photographic enforcement.
Cooper was asked by state Sen. Steve Southerland, R-Greeneville, to consider the issues of equal protection, due process and privacy raised by camera enforcement,concluded state law violates none of them.
It is the third opinion relating to camera enforcement issued by the attorney general's office since 2001.
